Terms of Service

Version 2026-09-14 · effective 8 September 2026

Workpass is a tool for recording attendance and preparing payroll. Your employer, not Workpass, is responsible for what you are paid and for meeting labour, tax and contribution obligations.

Agreeing to these terms

These terms are between you and Workpass (“Workpass”, “we”, “us”). By creating an account or using the app, you agree to them. If you are accepting on behalf of a business, you confirm you are authorised to bind that business.

If you do not agree, do not use Workpass.

What Workpass is, and what it is not

Workpass records attendance, calculates hours, and prepares payroll figures, payslips and contribution schedules from the rules and rates you enter.

It is a tool. It is not your accountant, your lawyer or your HR department, and using it is not a defence to anything:

Accounts

Keep your sign-in details to yourself. You are responsible for what happens under your account. Tell us at support@workpass.ph if you think someone else has access to it.

An employer may create an account for an employee and invite them to activate it. Only that employee may then use it. Clocking in for a colleague, or asking a colleague to clock in for you, is a misuse of the service and is likely also a matter for your employer.

What an employer must do

If you use Workpass to manage staff, you agree that:

Acceptable use

Do not use Workpass to break the law, to falsify a record of work, to harass anyone, or to reach data belonging to a business you do not work for. Do not attempt to defeat the app's verification checks, probe or attack the service, or resell it as your own.

The activity feed is for your own achievements. Do not post about another person, and do not post anything abusive. We can remove a post and suspend an account for either.

Subscription and payment

Some features require a paid subscription by the business. Prices, inclusions and the billing period are shown in the app before you subscribe.

Subscriptions are billed in advance for the period chosen and continue until cancelled. You can cancel at any time; the subscription then runs to the end of the period already paid for. Except where Philippine consumer law gives you a refund right, payments already made are not refundable.

If a payment fails we may suspend paid features. Your existing records stay intact, and attendance keeps recording.

Your data

Your records remain yours. We do not claim ownership of them and we do not sell them.

You can export payroll and attendance data from the app at any time. If you close your account, export what you need first: after a wind-down period the records are deleted.

We may use aggregated, de-identified information — counts and patterns that identify nobody — to understand and improve the service.

Availability

Workpass is provided as it is. We work to keep it available and correct, but we do not promise it will be uninterrupted or error-free, and we may change or withdraw features.

Attendance is the part that cannot wait for a server. The app keeps working offline for recording a shift and syncs when the connection returns; where it cannot record, it says so rather than pretending it did.

Liability

Nothing in these terms limits liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot be limited under Philippine law — including your rights under the Consumer Act and the Data Privacy Act.

Subject to that, we are not liable for indirect or consequential loss, for lost profits, or for loss arising from your own figures, rules or rates being wrong. Our total liability for any claim is limited to the subscription fees you paid us in the twelve months before the claim arose.

Payroll is a decision your business makes. We are not liable for an underpayment, an overpayment, a penalty or an assessment that follows from that decision.

Suspension and termination

You can stop using Workpass and close your account at any time.

We may suspend or close an account that breaks these terms, that is used to harm someone, or where the law requires it. Where we can, we will tell you why and give you a chance to put it right first.

Changes

We may change these terms. When a change affects you, we raise the version and ask you to accept it again the next time you open the app. If you do not accept, you can stop using the service and export your data.

This is version 2026-09-14, effective 8 September 2026.

Governing law

These terms are governed by the laws of the Republic of the Philippines, and the courts of the Philippines have jurisdiction over any dispute.
